Print Advertisers
CONTRACT: This contract is subject to all provisions of the Hawthorn Publications rate card. The publisher reserves the right to reject any advertising, which he/she feels is not in keeping with publication standards. No portion of the publication may be reproduced in any form without written consent.
A. PUBLISHER LIABILITY: Publisher will use caution to protect printing materials, but will not be liable for loss or damage. Film and materials will only be returned upon written request prior to press. Advertisers and advertising agencies assume liability for all content of advertisements printed, and for any subsequent claims against the publisher and further agree to indemnify publisher for any damages incurred resulting from such claims. It is agreed that no other liability shall arise between the advertiser and the publisher by reason of this advertising contract.
B. AD SUBMISSION: If advertiser does not approve advertisement within 14 days from submission of proof, or prior to press (whichever comes first), Hawthorn Publications will print advertisement as is, and advertiser releases Hawthorn Publications from any liability for omissions or errors. Any outstanding balance will be automatically applied to the credit card on file. If advertiser fails to submit any artwork prior press, Hawthorn reserves the right to design and print an advertisement to publisher specifications. Any associated design fees will be charged to advertiser and applied to credit card on file.
C. PAYMENT: All invoices are due and payable in two segments: One half of total advertising cost (including design and Elegala.com costs if applicable), is due upon submission of this agreement. Second half of cost is due upon approval of advertisement or thirty days from date of initial deposit, whichever comes first. If any advertisement is not camera-ready, client will be charged a $90 flat fee for any and all graphic design assistance. Deposits are nonrefundable. Hawthorn Publications will; however, refund all payments if unable to complete the brochure.
D. COPYRIGHT: Any advertisements designed by Hawthorn Publications are owned by Hawthorn Publications. Copyright may be purchased for $100.00.
E. COLOR ACCURACY: Hawthorn Publications cannot guarantee exact color accuracy on press. To provide best color accuracy, please provide a print and/or tear sheet.
F. SERVICE FEES: A contract fee of $25 will be applied for clients that choose not to submit a credit card. A service charge of $25 will be applied for all returned checks. A service charge of $10 will be applied for all declined credit cards. Interest will be charged at a rate of 1.5 % per month on past due balances (Annual Percentage Rate 18%). Should it be necessary to have an attorney or agency make demand for payment, or if suit is instituted to collect on this contract, or any part thereof, the advertiser agrees to pay these fees and all other costs incurred.

HAWTHORN LIABILITY: Hawthorn Publications will use caution to protect submitted materials, but will not be liable for loss or damage. Materials will only be returned upon written request prior to press. Advertisers and advertising agencies assume liability for all content posted, and for any subsequent claims against Hawthorn Publications, and further agree to indemnify publisher for any damages incurred resulting from such claims. It is agreed that no other liability shall arise between the advertiser Hawthorn Publications by reason of this contract.
MATERIAL SUBMISSION: If advertiser does not approve Web page content within 7 days from submission of proof, Hawthorn Publications will launch the Web page as is, and advertiser releases Hawthorn Publications from any liability for omissions or errors. Any outstanding balance will be automatically applied to the credit card on file. If advertiser fails to submit any artwork within 30 days from contract submission, Hawthorn reserves the right launch a Web page to standard specifications, using stock images and any other content available.
PAYMENT: Full payment is due upon submission of contract. Payment will apply to one full year of online visibility. Payments are non-refundable.
COPYRIGHT: All Web pages on Elegala.com are designed and owned by Hawthorn Publications and may not be reproduced without written consent of the publisher.

Websites
All website template designs are owned by Hawthorn Publications and may not be reproduced or sold without written consent. Upon receipt of full payment, client maintains the right to his completed site and may alter it as he sees fit. Client may choose to host his website elsewhere. However, in this instance, Hawthorn Publications does not maintain responsibility for content integrity or down-time. Client assumes all responsibility to creative rights of photos and content published on his site. Breach of this contract may result in a legal dispute. Client agrees to pay all attorney's fees. Jurisdiction lies in the state of New Hampshire.
